On May 28, local time in the United States, the US Federal Court blocked the T86 tariff policy announced by Trump on April 2 from taking effect, ruling that the president had overstepped his authority by imposing comprehensive tariffs on countries that export more to the US than they import. The court stated that the US Constitution gives the US Congress the exclusive right to regulate trade with other countries. According to the court's judgment, the "Clause 321", which refers to the previously cancelled $800 duty - free exemption, was set to be restored. The ruling gave the executive branch up to 10 days to complete the process of ceasing the collection of tariffs.

However, on May 29, the US Court of Appeals for the Federal Circuit granted the Trump administration's request to temporarily suspend the ruling of the US Court of International Trade. The court ordered both sides to submit written arguments on the issue of blocking the collection of tariffs, and the relevant documents are required to be submitted early next month. This means that the Trump administration can continue to implement the tariff policy for the time being.
